Motor Vehicle Sale Agreement Zimbabwe

Complete template with change of ownership guide for ZINARA/CVR

What Is a Vehicle Sale Agreement?

A motor vehicle sale agreement is a legally binding document that records the sale of a vehicle from one party (the seller) to another (the buyer). It captures all essential details of the transaction including the identities of both parties, a full description of the vehicle, the purchase price, payment terms, warranty disclaimers, and acknowledgements regarding the vehicle's condition.

In Zimbabwe, vehicle transactions are governed by common law principles of contract (the emptio venditio or sale), the Road Traffic Act [Chapter 13:11] (for registration and ownership), and the Consumer Protection Act (for dealer sales). The vehicle registration system is administered by ZINARA (Zimbabwe National Road Administration) through the Central Vehicle Registry (CVR).

Whether you are buying from a private seller in Mbare, a dealership on Samora Machel Avenue, or selling your own vehicle through Facebook Marketplace, a written sale agreement is your primary protection against fraud, disputes, and financial loss. Vehicle fraud is unfortunately common in Zimbabwe, and a comprehensive agreement helps mitigate these risks.

Buyer Beware: Always verify the vehicle's registration details at ZINARA before making any payment. Check that the seller's name matches the registration book, that the chassis and engine numbers on the vehicle match those in the book, and that there are no outstanding liens or finance agreements. If the seller cannot produce the original registration book (blue book), do not proceed.

When Do You Need This Agreement?

  • Private sale — Selling or buying a vehicle from an individual
  • Dealer sale — Purchasing from a registered motor dealer
  • Trade-in — When part-exchanging a vehicle at a dealer
  • Instalment sale — Where payment is made in instalments (hire purchase)
  • Company vehicle sale — When a business sells a fleet vehicle to an employee or third party
  • Cross-border sale — Selling to a buyer in another country (additional export requirements apply)

Key Information That Must Be Included

1. Vehicle Description

A complete and accurate description of the vehicle is essential. Include:

DetailWhy It Matters
Make and ModelIdentifies the vehicle type (e.g., Toyota Hilux, Nissan NP300)
Year of ManufactureConfirms the vehicle's age
Registration NumberLinks to the ZINARA/CVR registration record
Engine NumberUnique identifier — must match registration book
Chassis/VIN NumberUnique identifier stamped on the vehicle frame — must match registration book
ColourAs recorded in the registration book
Odometer ReadingRecorded mileage at time of sale
Fuel TypePetrol, diesel, or hybrid
TransmissionManual or automatic

2. Purchase Price and Payment

State the full purchase price in both figures and words, the currency of payment, and the payment method. For cash transactions, specify the denomination. For bank transfers, include the account details and reference. For instalment sales, include a full payment schedule with dates and amounts.

3. Condition and Warranty

For private sales, the vehicle is typically sold “voetstoots” (as is, where is), meaning the buyer accepts the vehicle in its current condition with all faults. However, the seller must not actively conceal known defects — doing so constitutes fraud. Specify any known defects, recent repairs, or items not in working order.

4. Ownership and Encumbrances

The seller must warrant that they are the legal owner of the vehicle, that the vehicle is free from any liens, finance agreements, or encumbrances, and that no other party has a claim to the vehicle. If there is outstanding finance, the process for settling it must be clearly documented.

Critical Warning: Never pay for a vehicle without seeing the original registration book (blue book). If the seller says the book is “at the bank” or “being processed,” this may indicate the vehicle is still on finance. Pay only after the book has been produced and verified against the vehicle.

How to Transfer Vehicle Ownership at ZINARA/CVR

After the sale is complete, follow these steps to transfer ownership:

  1. Both parties visit a ZINARA office — Bring national IDs, the sale agreement, and the original registration book
  2. Complete the Change of Ownership form — Available at the ZINARA counter; both buyer and seller must sign
  3. Pay the transfer fee — The buyer typically bears this cost
  4. Submit documents — The form, sale agreement, IDs, and registration book are submitted
  5. Receive new registration — Processing takes 1–5 working days; the buyer receives an updated registration book

Documents Required at ZINARA

  • Original vehicle registration book (blue book)
  • National ID cards for both buyer and seller (originals and copies)
  • Signed vehicle sale agreement
  • Valid vehicle fitness certificate (recommended)
  • Proof of payment (bank receipt, EcoCash confirmation)
  • Company documents if either party is a company (CR14, board resolution)

Step-by-Step Guide for Buyers

Step 1: Verify the Vehicle

Before agreeing to buy, physically inspect the vehicle and compare the engine number and chassis number against the registration book. Check for signs of tampering. If in doubt, take the vehicle to a trusted mechanic for an inspection.

Step 2: Verify Ownership at ZINARA

Visit ZINARA with the registration number and request a vehicle search. This will confirm the registered owner and any encumbrances. The small fee for this search can save you from buying a stolen or encumbered vehicle.

Step 3: Check for Outstanding Finance

If the registration book is held by a bank or finance company, the vehicle is still on finance. The seller must settle the finance before the sale can proceed. Never pay the seller directly and expect them to settle the finance — pay the finance house directly if possible.

Step 4: Complete and Sign the Agreement

Fill in all vehicle details accurately. Both parties sign with witnesses present. Each party retains a signed original.

Step 5: Make Payment

Pay using a traceable method (bank transfer or EcoCash) where possible. Obtain a receipt. If paying cash, count in the presence of both parties and witnesses.

Step 6: Transfer Ownership Promptly

Complete the ZINARA transfer within 7 days. Until the transfer is complete, the seller remains the registered owner and may be liable for fines, tolls, or accidents.

Common Mistakes to Avoid

1. Buying Without Seeing the Registration Book

If the seller cannot produce the original blue book, the vehicle may be stolen, still on finance, or not owned by the seller. Never buy a vehicle without the original registration book in hand.

2. Not Verifying Engine and Chassis Numbers

Physically check that the engine and chassis numbers on the vehicle match those in the registration book. Discrepancies indicate the vehicle may have been rebuilt, cloned, or stolen.

3. Paying Before Transfer

Ideally, payment should be made simultaneously with the ownership transfer at ZINARA. If this is not possible, make payment conditional on the seller attending the transfer within a specified period.

4. No Written Agreement

Handshake deals for vehicle sales are a recipe for disaster. Without written proof, the buyer cannot prove they paid, and the seller cannot prove they disclosed known defects.

5. Ignoring the Voetstoots Clause

Buyers must understand that “voetstoots” means the vehicle is sold as is. If you discover faults after the sale, you generally have no recourse unless the seller deliberately concealed known defects. Always get a mechanic to inspect before buying.

Frequently Asked Questions

Is a written agreement required to sell a vehicle in Zimbabwe?
Not strictly required by law, but strongly recommended. A written agreement documents the transaction, protects both parties, and is essential evidence if disputes arise.
How do I transfer vehicle ownership?
Both buyer and seller visit a ZINARA/CVR office with IDs, the sale agreement, and the registration book. Complete the Change of Ownership form, pay the transfer fee, and submit. Processing takes 1-5 working days.
What documents do I need to sell a vehicle?
Vehicle registration book (blue book), national ID, sale agreement, valid fitness certificate (if available), and ZINARA road tax disc. If on finance, a clearance letter from the finance house.
Can I sell a vehicle still on finance?
Yes, but the outstanding balance must be settled first. The finance company holds the registration book. Get a settlement figure, pay it off, obtain a clearance letter, then proceed with transfer.
Is there a cooling-off period?
No. Zimbabwe has no statutory cooling-off period for private vehicle sales. Once signed and paid, the sale is final. Inspect thoroughly before signing.
