What Is a Power of Attorney?

A Power of Attorney (POA) is a legal instrument that authorises one person (the agent or attorney-in-fact) to act on behalf of another person (the principal) in legal, financial, or business matters. In Zimbabwe, Powers of Attorney are governed by common law and, for property matters, the Deeds Registries Act [Chapter 20:05].

A POA is particularly important for Zimbabweans in the diaspora who need to manage property, register companies, or handle legal matters back home without being physically present.

What Should a POA Include?

  • Full names and ID/passport numbers of both the principal and the agent
  • Clear statement of powers granted — be as specific as possible
  • Effective date and duration (or specify when it expires)
  • Limitations — what the agent cannot do
  • Revocation clause — how the principal can revoke the POA
  • Signature of the principal before a Notary Public or Commissioner of Oaths
  • Two witnesses (recommended, required for some uses)

POA for Diaspora Zimbabweans

If you are a Zimbabwean living abroad (UK, South Africa, USA, Australia, etc.), you will often need a POA to handle matters in Zimbabwe. The process is:

  1. Draft the POA — Use our template or have a lawyer draft one specific to your needs
  2. Sign before a Notary Public in your country of residence
  3. Authenticate the document — Either:
    • Have it apostilled (if the country is party to the Hague Apostille Convention), or
    • Have it authenticated by the Zimbabwe Embassy in your country
  4. Send the original to your agent in Zimbabwe (courier recommended — DHL, FedEx)
Important: Zimbabwe is not a party to the Hague Apostille Convention (as of 2026). This means POAs executed abroad generally need to be authenticated at a Zimbabwe Embassy or Consulate. Check with your nearest Zimbabwe mission for their specific requirements and fees.

POA for Property Transactions

For buying, selling, or transferring property in Zimbabwe, a Notarial Power of Attorney is required. This must be:

  • Executed before a Notary Public (not just a Commissioner of Oaths)
  • Registered with the Deeds Registry if it involves immovable property
  • Specific about the property (stand number, title deed reference)

Revoking a Power of Attorney

A POA can be revoked at any time by the principal, provided they have mental capacity. To revoke:

  1. Prepare a written Notice of Revocation
  2. Serve the notice on the agent personally
  3. Notify any third parties who were dealing with the agent (banks, Deeds Registry, etc.)
  4. If the POA was notarised, the revocation should also be notarised
