Types of Marriage in Zimbabwe
Zimbabwe law recognises two forms of marriage, each governed by separate legislation:
| Type | Legislation | Key Features |
| Civil Marriage | Marriage Act [Chapter 5:11] | Monogamous, registered at Civil Registry, equal property rights |
| Customary Marriage | Customary Marriages Act [Chapter 5:07] | May be polygamous, requires lobola/roora, registered at District Administrator's office |
A civil marriage under Chapter 5:11 is the most common form and provides the strongest legal protections for both spouses, including equal property rights and automatic inheritance rights.
Requirements for a Civil Marriage
- Both parties must be at least 18 years old (16–17 with parental consent and ministerial approval)
- National ID or passport for both parties
- Birth certificates for both parties
- Proof of single status — If previously married: death certificate of former spouse or final divorce order
- Marriage banns — Published for 3 consecutive Saturdays at the magistrates' court (or a Special Licence to skip the banns)
- Two witnesses who are at least 18 years old
- Marriage officer — A magistrate, marriage officer, or minister of religion
Special Licence: If you do not want to wait for marriage banns (3 weeks), you can apply for a Special Marriage Licence from the Minister of Justice. This costs more but allows you to marry immediately.
Requirements for a Customary Marriage
- Payment of lobola/roora (bride price) — Amount negotiated between families
- Both families must consent to the marriage
- Registration at the District Administrator's office within 3 months of the marriage ceremony
- Witnesses from both families
How to Register a Marriage
Step 1: Banns or Special Licence
Visit the magistrates' court in the district where the marriage will take place. Complete the banns form and pay the fee. Banns are published for 3 Saturdays. Alternatively, apply for a Special Licence.
Step 2: Marriage Ceremony
The marriage is solemnised by an authorised marriage officer in the presence of two witnesses. The marriage officer completes the marriage register.
Step 3: Obtain the Certificate
The marriage officer issues a marriage certificate immediately after the ceremony. A copy is sent to the Registrar-General for permanent record.
