Residential Lease Agreements in Zimbabwe

A lease agreement (also called a rental agreement or tenancy agreement) is a legally binding contract between a landlord (lessor) and a tenant (lessee) that sets out the terms under which the tenant will occupy the landlord’s property. In Zimbabwe, the rental of residential property is primarily governed by common law principles, with certain protections for tenants provided by statute.

While there is no single comprehensive “Tenancy Act” in Zimbabwe, relevant legislation includes the Rent Regulations (for designated areas), the Magistrates Court Act (for eviction procedures), and various municipal by-laws. The common law of lease (derived from Roman-Dutch law) provides the foundational framework for the landlord-tenant relationship.

Written vs Verbal: A verbal lease is valid for terms under one year, but a written lease is always recommended. For any lease exceeding 12 months, it must be in writing to be enforceable. A written lease protects both parties and is essential evidence in any dispute.

What a Lease Agreement Must Include

A well-drafted residential lease agreement should contain the following essential terms:

Landlord’s Rights and Obligations

Under Zimbabwean law, the landlord has the following key obligations:

  • Deliver the property in a habitable condition at the start of the lease
  • Maintain the structure — the roof, walls, plumbing, and electrical systems (unless the lease states otherwise)
  • Not disturb the tenant’s peaceful enjoyment of the property
  • Return the deposit at the end of the lease, less legitimate deductions for damage
  • Give proper notice before entering the property (except in emergencies)

The landlord has the right to:

  • Receive rent on time as agreed
  • Inspect the property with reasonable notice
  • Take legal action for breach (unpaid rent, property damage, illegal use)
  • Apply to court for eviction where the tenant breaches the lease

Tenant’s Rights and Obligations

The tenant is obligated to:

  • Pay rent on time as stipulated in the lease
  • Use the property for its intended purpose (residential)
  • Keep the property in reasonable condition and report damage promptly
  • Not make structural alterations without the landlord’s written consent
  • Not sublet without the landlord’s written permission
  • Return the property in substantially the same condition (fair wear and tear excepted)

The tenant has the right to:

  • Peaceful enjoyment of the property without interference
  • A habitable property with functioning essential services
  • Reasonable notice before landlord inspections
  • Protection from illegal eviction
  • Return of the security deposit (less legitimate deductions)

The Eviction Process

Eviction in Zimbabwe must follow a legal process. Self-help eviction is illegal. A landlord cannot change locks, cut off water or electricity, remove the tenant’s belongings, or intimidate the tenant into leaving.

The correct procedure is:

  1. Written notice — Serve the tenant with a written notice specifying the breach and giving them a reasonable period to remedy it (typically 7-30 days depending on the breach).
  2. Cancellation of lease — If the tenant fails to remedy the breach, the landlord cancels the lease in writing.
  3. Court application — File an application for an eviction order at the Magistrates Court with jurisdiction over the property.
  4. Court hearing — The court hears both parties and, if satisfied that the eviction is justified, grants an eviction order.
  5. Execution — If the tenant still does not vacate, the Sheriff of the Court executes the eviction order.
Important: A landlord who evicts a tenant without a court order commits a criminal offence and can be sued for damages. Always follow the legal process, no matter how frustrating the situation may be.

Security Deposits

There is no statutory limit on security deposits in Zimbabwe, but the market standard is one to three months’ rent. Best practices include:

  • Recording the deposit amount in the lease agreement
  • Conducting a thorough move-in inspection with a signed checklist and photographs
  • Conducting a move-out inspection with the tenant present
  • Returning the deposit within 14-30 days of the tenant vacating, with an itemised list of any deductions
  • Only deducting for actual damage beyond normal wear and tear — faded paint, minor scuff marks, and worn carpets are normal wear and tear
